Florida Abortion Restrictions
Knowing what abortion restrictions are in Florida will help you better understand the care you can receive.
Florida law requires a person to have two appointments at least 24 hours apart to obtain an abortion. The first visit will include lab work, an ultrasound, education, and options information, and a meeting with a doctor to discuss the abortion procedure. The second visit will include the abortion procedure.
24 Hour Mandatory Waiting Period
6 Week Ban (effective 5/1/2024)
After 2 years of litigation, the Florida Supreme Court voted to uphold the 15-week abortion ban passed in 2022 thus starting the 30-day countdown for the 6 week abortion ban . The only exceptions to this ban are for survivors who got pregnant as the result of a sexual assault, incest, and human trafficking and are cooperating with law enforcement. We consider this a total abortion ban.
You have the right to decide to have an abortion if you are under 18. But Florida state law requires most young people under 18* to involve a parent or legal guardian in their decision. If you can’t involve your parent or legal guardian, you have the option of asking a judge to let you get an abortion without involving a parent. This process is called judicial bypass.
